Caribbean Photo Contest Rules

TERM

The “All Entrants” contest begins April 20, 2025, at (12:01:00 AM) US Eastern Standard Time (EST) and ends May 24, 2025, at 11:59:00 pm US Eastern Standard Time (EST) (the “contest”).

All entries must be received by the Entry Deadline. By submitting an entry, each entrant agrees to the Official Rules and warrants that the entrant’s submission follows all requirements set out in the Official Rules. This is a skill-based contest and chance plays no part in the determination of winners.

WHO MAY ENTER

The competition is open to any living photographer, 18 years of age or older as of the date of entry, from any country. The Caribbean Photo Contest is a skill-based competition and chance plays no part in the determination of winners.

HOW TO ENTER

Purchase is necessary to enter this contest.

Each Entry consists of an entry form, a single image or series of images, and an entry fee. The “All Entrants” contest entry fee is USD $25 per entry for a single image/ $35.00 per entry for a Series (2 to 5 images). To enter, visit www.caribbeanphotocontests.com to complete an entry form with the required information, including your name, address, telephone number, e-mail address, and photo caption (if desired, but not required); and submit along with your fee and photograph in accordance with the instructions that follow. Each entry must comply with the following requirements (the “Photograph Requirements”):

REQUIREMENTS

Photographs must be in digital format. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest. The photograph need not be taken with a digital camera; scans of negatives, transparencies or photographic prints are acceptable. Digital photographs should be submitted at 150dpi.

All digital files must not exceed 4MB (megabytes) per file in RGB format, or saved as JPEGs (.jpg) format, and must be at least 1,000 pixels wide (if a horizontal image) or 1,000 pixels tall (if a vertical image). Photographs must have been taken within two (2) years before the date of entry and may not have previously won an award in the Caribbean Photo Contest.

Only minor burning, dodging and/or color correction is acceptable, as is cropping. High dynamic range images (HDR) and stitched panoramas are NOT acceptable. Any changes to the original Photograph not itemized here are unacceptable and will render the Photograph ineligible for a prize.

Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; provided that entrants must be prepared to provide a release form as described below in “Release”. Photographing the work of others is NOT allowed.

The photograph, in its entirety, must be a single or series of works of original material taken by the Contest entrant. By entering the Contest, entrant represents, acknowledges and warrants that the submitted photograph is an original work/s created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photograph.

The photograph must not, in the sole and unfettered discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, pornographic, or otherwise objectionable or inappropriate content.

The entries will be judged in accordance with the Judging Criteria, as defined below. All entries must be submitted and received by May 24, 2025, at 11:59:00 pm US Eastern Standard Time (EST). Proof of submission is not proof of receipt. Entries must be made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, Internet domain owner, or other person or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The sponsor reserves the right to examine the original photograph/source material in order to confirm compliance with these rules.

Note: The entry submission page is expected to receive many visitors immediately before the entry deadline. If the website is experiencing a lot of traffic, issues may arise such as slow processing times or the inability to submit entries. To avoid these potential problems, you are encouraged to submit your entries about 14 days before the entry deadlines.

ENTRY FEES

Single Image: $25.00 USD
Series (2 to 5 images) *: $35.00 USD

All Entrants must include the appropriate entry fee payable in U.S. currency.

PAYMENT: The entry fee consists of two submission options 1) $25 USD – single image entrance fee or 2) $35.00 USD-Series (2 to 5 images) entrance fee. There is no limit on the number of entries.

CATEGORIES

The Spring – 2025 contest is an “Open Theme”. There is no limit on the number of entries per person. Each entry must comply with the following requirements previously stated above.

IDENTIFYING MARKS & SIGNATURES

No signature, stamp or any other identifying mark is allowed anywhere on the image or digital file. Any submissions that include or contain such marks are automatically disqualified.

CONTEST PRIZES

One (1) Grand Prize will be awarded.

Grand Prize: One (1) Five (5)-day four (4) nights’ accommodation in Saint Lucia for the winner and one (1) guest in 2025; The winning image or images will be featured on the CPC website, newsletter, and social media.

The Grand Prize will include five (5)-day four (4) nights’ accommodation in Saint Lucia which includes ground transportation between the airport and hotel; and meals and other items including trip details are determined by Sponsor in its sole discretion. Travel must be completed by December 31, 2026, or the prize trip will be forfeited. Airfare is NOT included. Travel expenses to/from the prize winner’s home city are not included. Trip dates relate to travel from the United States. Accommodation is subject to availability. Trip specifics are subject to availability. Travelers agree to accept the Caribbean Photo Contest terms and conditions for the trip. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation; meals; incidentals; gratuities; passenger tariffs or duties; airline fees; surcharges; airport fees; service charges or facility charges; personal charges such as alcoholic beverages, spa services, and Internet usage; security fees; taxes or other expenses are the responsibility solely of winner. The winner and his/her travel companion must execute liability/publicity releases prior to issuance of travel documents. The winner and travel companion are solely responsible for obtaining valid passports and any other documents necessary for international travel. The sponsor reserves the right to substitute the trip for one of equal or greater value if the designated prize should become unavailable for any reason.

The approximate Retail Value (“ARV”) of the First Prize is US $6,250.

Potential winners shall be required to sign and return within ten (10) days following an attempted notification, an Affidavit, Declaration or Certificate of Eligibility, Liability Release, and where legally permissible, a Publicity Release and Warranty of Ownership and License in which the entrant warrants that he/she is the owner of the photograph (and all the intellectual property rights in the photograph submitted) and grants to Sponsor and its licensees the irrevocable, perpetual, worldwide non-exclusive license to reproduce, distribute, display, and create derivative works of the entry (along with a name credit) in connection with the Contest and promotion of the Contest without additional compensation. Failure to execute and deliver any required documents to Sponsor by the specified deadline may result in disqualification from the Contest, and selection of an alternate potential winner. No prize transfer, assignment, or substitution by winners allowed. If a prize (or part of a prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law.

NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY E-MAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATIVE POTENTIAL WINNER.

Second Prize

JUDGING PROCESS 

The Caribbean Photo Contest follows a two-tiered voting process to determine the winners:

The First Round consists of Public Voting. Public Voting Period: May 25 – May 31, 2025All eligible contest entries are open for public voting. The most popular entries, based on public votes, advance to the next round. The Second Round consists of the Judges’ Panel Evaluation. Judging Panel Review: June 1 – June 7, 2025A panel of expert judges in photography (the “Judges”) will review the finalist entries. 

Each entry will be evaluated using the following Judging Criteria: Creativity (50%) Photographic Quality (50%)

*Judges will select the Finalists, from which they will determine the Grand Prize Winner, Finalists, and Honorable Mentions. The Grand Prize Winner, Finalists, and Honorable Mentions will be officially announced and published on the Caribbean Photo Contest website and social media platforms. *Limit one (1) Grand prize winner. (Please Note: The results will render only one (1) Grand Prize winner and three (3) finalist/s and one Honorable Mention). Prize winners will be notified by email and announced on our website, e-newsletter, no later than 6 weeks after the end date of the contest.)

**The CPC reserves the exclusive right regarding judging to determine winners. Decisions of the Judges are final and binding. Sponsors reserve the right not to award all prizes in the event an insufficient number of eligible entries are received, as determined by Sponsors and Judges in their sole discretion.

ANNOUNCEMENT OF WINNERS

Entrants are responsible for following these Official Rules. One (1) Grand Prize winner will be notified the week of June 11 – June 14, 2025, via email and on the CPC website at www.caribbeanphotocontests.com.

ENTRANT LICENSES/RELEASES

By submitting images, you understand and agree that selected entries and the entrants’ names can and may be used and published by Caribbean Photo Contest LLC or any other Authorized Party in any CPC contest and all CPC promotional or advertising material, publications, or its own website, or any other media at the discretion of the CPC. All copyrights are retained by the photographer. Recognition will be given to the photographer whenever possible. By entering the Contest, all entrants grant a royalty free irrevocable perpetual non-exclusive license in the entries to Authorized parties and Acknowledge that Authorized Parties may use the entries and a name credit in any media now or hereafter known, without the restriction, including commercially fully using and exploiting the entries possible. Display or publication of any entry on an Authorized Party’s website does not indicate the entrant will be selected as a winner. Authorized parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation. Consequently, by entering, each entrant grants to Authorized Parties the unrestricted right to use all statements made in connection with the Contest, and pictures or likeness of Contest entrants, or choose not to do so, at their sole discretion. Authorize Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation. If the photograph or photographs submitted contain any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.

Upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed release from all persons who appear in the photograph submitted, and/or from the owner of any material that appears in the photograph entry, authorizing Sponsor and its licensees (“Authorized Parties”) to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification at any time during the Contest and the selection of an alternate winner.

Similarly, upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed written license from the copyright owner of any sculpture, artwork or other copyrighted material that appears in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

Finally, upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed written license from the owner of any private property included in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

For the purposes of these Official Rules, the entrant will be deemed to be in receipt of Sponsor’s request or notification, (a) in the event that Sponsor sends the request by postal mail, five business days after the request was sent by Sponsor, or (b) in the event that Sponsor sends the request by e-mail, on the day that the e-mail was sent by Sponsor.

By participating, contest participants grant the Sponsors and their designees, licensees, or affiliates (the “Authorized Parties”) a non-exclusive, worldwide license, through December 24, 2029, to reproduce, distribute, display, and post the entries online so that viewers may view all competing entries. In addition, each WINNER grants to the Authorized Parties a license for use of his/her winning entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known, including but not limited to, print or digital publication on the CPC Website showcasing the winners; and promotions related to the contest. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.

THIRD PARTY RELEASES/LICENSES

Winners authorize Caribbean Photo Contest LLC to reproduce, distribute, display and create derivative works of the photograph entry in connection with 2025/26 Caribbean Photo Contest and promotion of 2025/26 Caribbean Photo Contest, in any media now or hereafter known, including but not limited to: publication on The CPC website showcasing the winners; The 2025/26 Caribbean Photo Contest online gallery; the 2025/26 Caribbean Photo Contest Website and in exhibits and promotions related to the 2025/26 Caribbean Photo Contest.

LIMITATION OF LIABILITY

By participating, entrants agree to release, discharge and hold harmless Caribbean Photo Contest LLC, and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

CONDITIONS

THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the State of Delaware and the forum for any dispute shall be in the State of Delaware, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries void if the Sponsor determines the photograph to not be original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these “All Entrants” Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins, that Sponsor may use the winning photographs and each winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law). All federal, state/provincial/territorial, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or do not respond within 10 days to a winner notification as required by the “Contest Prizes” Rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant.

The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

RIGHT TO CANCEL OR SUSPEND CONTEST

If for any reason the Contest is not capable of running as planned, due to a cyber-attack or attacks, infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsors elect to cancel or terminate the Contest, Sponsors will not retain any rights in the submitted photographs and will return the entry fees.

DATA PRIVACY

Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The Sponsor may also use the data to verify the participant’s identity, postal address, and telephone number or to verify the participant’s eligibility to participate in the Contest. Participants have the right to access, review, rectify or cancel any personal data held by Sponsor by writing to Sponsor at [email protected]. Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.

NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by Caribbean Photo Contest to mail skill contests or sweepstakes. To elect to have an individual’s name excluded from all such lists, submit a removal request in writing at [email protected]. This notification system may be used to prohibit mailing of all skill contests or sweepstakes by the Caribbean Photo Contest to such individuals.

DISCLAIMERS

Caribbean Photo Contest is in no way sponsored, endorsed, or administered by, or associated with TikTok, Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn, or Google. You understand that you are providing your information to the owner of this contest and not to TikTok, Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn, or Google.

You will not be notified upon our receipt of your entry. Further, please be aware that we are unable to respond to any requests to confirm our receipt of an entry.

Entries will not be accepted by any method other than the Internet.

Entrants will be responsible for all costs associated with entering the contest.

By entering this contest, the entrant will be deemed to have agreed to the terms and conditions stated in these Entry Guidelines.

The Organizer has final decision-making authority regarding any matters not specified in these Entry Guidelines. If an entrant disagrees with the decision of the Organizer, the entrant may withdraw from the contest. The entrant will be responsible for all costs associated with withdrawal from the contest.

Please be aware that the Organizer may completely or partially postpone or suspend acceptance of entries if it determines that the smooth running, safety, or fairness in judging of this contest would be compromised for reasons beyond the Organizer’s control, such as network failures, computer viruses, or unauthorized server access.

Please be aware that, in the judging and usage of submitted works, due to printing variation or other factors, it may not be possible to strictly reproduce the color tones or presentation intended by the entrant, and that parts of works may be cropped for publicity purposes.

Please be aware that we will not be able to respond to any inquiries, complaints, objections, or the like regarding the judging results of this contest.

Prizes are subject to change without notice depending on product lineup.

If delivery of a prize is delayed or made impossible due to international factors, legal issues, or other circumstances, a prize may be substituted with a monetary award designated by the Organizer. Moreover, if delivering a monetary award or prize directly is difficult, we may take measures such as delivery via a third country or third party to the extent possible.

Responsibility

Although entries will be managed with the utmost care, the Organizer assumes no responsibility for any accident, damage, loss, or other problems that occur during data transmission.

The Organizer assumes no responsibility for any network failures, computer viruses, unauthorized server access, or other circumstances beyond the Organizer’s control, or for any damages or the like incurred by the entrant in connection with such circumstances.

The Organizer assumes no responsibility for damages that the entrant may suffer in connection with entering this contest.

Entrants will be deemed to have obtained prior consent from the subjects, original authors, or other right holders for the use of any subjects, copyrighted material, or the like that is used in their entries. Any resulting complaints or objections are not the responsibility of the Organizer and must be resolved entirely by the entrant.

Any complaints or claims of rights infringement, compensation of damages, or the like by third parties in connection with the submitted work are not the responsibility of the Organizer and must be resolved entirely by the entrant.

Any problems that arise regarding similarities to the submitted work or the like must be resolved entirely by the parties between themselves. Any resulting complaints or objections are not the responsibility of the Organizer and must be resolved entirely by the entrant.

The liability towards entrants of the Organizer, any third parties cooperating with the Organizer to run this contest, and the judges will also be managed in accordance with the above.

Entrant’s Rights

The copyright and any equivalent rights to the submitted work will belong to the entrant. However, the Organizer will have the rights set forth in “Organizer’s Rights” below in connection with the submitted work.

Organizer’s Rights

The Organizer will have the right to publish any work on its official social media accounts during the judging period for the purpose of publicizing this contest. However, this does not guarantee that the work will win a prize.

The Organizer reserves the right to publish works that reach the final judging stage of this contest on affiliated websites and social media accounts. Works published by the Organizer may be cropped when displayed.

The Organizer will have the perpetual, non-exclusive right, for the purposes of publicizing this contest and contributing to photography culture in general, to authorize the publication; reproduction; presentation; public transmission to social media, the Internet, email newsletters, etc.; exhibition; printing; distribution; adaptation; or screening of the winning works, without compensation, with credit given, and without requiring the winners’ permission, on websites or official social media accounts or at photo exhibitions, video-related events, other exhibitions, or the facilities that host them, which are managed or organized by Caribbean Photo Contest or the Organizer’s authorized local agents (hereinafter referred to, with the inclusion of the Organizer, as the “Organizer or its Affiliates”).

The Organizer has the right to transfer printed materials or other reproductions of the winning entries to a third party after the exhibition is completed without the permission of the winners.

To the extent that winning works are exhibited at exhibitions and the like, there may be restrictions on the winning works to be exhibited due to global events or circumstances in the area of the exhibition.

The Organizer will announce the names of the winners and the titles of the winning works on websites connected with this contest, official social media accounts, exhibitions, and the like. Entrants should also review our Privacy Statement at https://www.caribbeanphotocontest.com/privacy

Notwithstanding the above, the Organizer or its Affiliates may not give credit if using all or parts of winning works in publicity posters, tickets, pamphlets, or other media for photo exhibitions or video-related events or on websites or social media accounts managed by the Organizer or its Affiliates where all or parts of winning works are used in videos or images with image effects such as collages or in other circumstances where it would be difficult to give credit.

Winners will not exercise any moral rights regarding the use of winning works by the Organizer or its Affiliates.

Upon obtaining the consent of the entrant or winner, the Organizer will have the perpetual, non-exclusive right, for purposes other than those stated above, to authorize the publication, reproduction, presentation, public transmission, exhibition, printing, distribution, adaptation, or screening of a submitted or winning work, without compensation, with credit given, and stating that the work was submitted to or won this contest.

If the Organizer determines that an entry violates the entry guidelines, the entry will be invalid. No notice of the entry’s invalidity will be given.

If an entrant is found to be in violation of the terms or conditions after a prize has been awarded, the Organizer can cancel the award and demand the return of the prize.

These Entry Guidelines will be interpreted in accordance with the laws of the State of Delaware.

The terms and conditions of entry are subject to change without notice. Any disputes that may arise between the entrant and the Organizer will be subject to the exclusive jurisdiction of the State of Delaware as the court of first instance.

The “College Students” contest begins April 20, 2025, at (12:01:00 AM) US Eastern Standard Time (EST) and ends May 24, 2025, at 11:59:00 pm US Eastern Standard Time (EST) (the “contest”).

Each Entry consists of an entry form, a single image or series of images, and an entry fee. The “All Entrants” contest entry fee is USD $25 per entry for a single image/ $35.00 per entry for a Series (2 to 5 images). REQUIREMENTS

Photographs must be in digital format. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest. The photograph need not be taken with a digital camera; scans of negatives, transparencies or photographic prints are acceptable. Digital photographs should be submitted at 150dpi.

All digital files must not exceed 4MB (megabytes) per file in RGB format, or saved as JPEGs (.jpg) format, and must be at least 1,000 pixels wide (if a horizontal image) or 1,000 pixels tall (if a vertical image). Photographs must have been taken within two (2) years before the date of entry and may not have previously won an award in the Caribbean Photo Contest.

Only minor burning, dodging and/or color correction is acceptable, as is cropping. High dynamic range images (HDR) and stitched panoramas are NOT acceptable. Any changes to the original Photograph not itemized here are unacceptable and will render the Photograph ineligible for a prize.

Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; provided that entrants must be prepared to provide a release form as described below in “Release”. Photographing the work of others is NOT allowed.

The photograph, in its entirety, must be a single or series of works of original material taken by the Contest entrant. By entering the Contest, entrant represents, acknowledges and warrants that the submitted photograph is an original work/s created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photograph.

The photograph must not, in the sole and unfettered discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, pornographic, or otherwise objectionable or inappropriate content.

The entries will be judged in accordance with the Judging Criteria, as defined below. All entries must be submitted and received by May 24, 2025 at 11:59:00 pm US Eastern Standard Time (EST). Proof of submission is not proof of receipt. Entries must be made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, Internet domain owner, or other person or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The sponsor reserves the right to examine the original photograph/source material in order to confirm compliance with these rules.

Note: The entry submission page is expected to receive many visitors immediately before the entry deadline. If the website is experiencing a lot of traffic, issues may arise such as slow processing times or the inability to submit entries. To avoid these potential problems, you are encouraged to submit your entries about 14 days before the entry deadlines.

The Spring – 2025 contest is an “Open Theme”. There is no limit on the number of entries per person. Each entry must comply with the following requirements previously stated above.

IDENTIFYING MARKS & SIGNATURES

No signature, stamp or any other identifying mark is allowed anywhere on the image or digital file. Any submissions that include or contain such marks are automatically disqualified.

CONTEST PRIZES

One (1) Grand Prize will be awarded.

Grand Prize: One (1) Five (5)-day four (4) nights’ accommodation in Saint Lucia for the winner and one (1) guest in 2025; The winning image or images will be featured on the CPC website, newsletter, and social media.

The Grand Prize will include five (5)-day four (4) nights’ accommodation in Saint Lucia which includes ground transportation between the airport and hotel; and meals and other items including trip details are determined by Sponsor in its sole discretion. Travel must be completed by December 31, 2026, or the prize trip will be forfeited. Airfare is NOT included. Travel expenses to/from the prize winner’s home city are not included. Trip dates relate to travel from the United States. Accommodation is subject to availability. Trip specifics are subject to availability. Travelers agree to accept the Caribbean Photo Contest terms and conditions for the trip. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation; meals; incidentals; gratuities; passenger tariffs or duties; airline fees; surcharges; airport fees; service charges or facility charges; personal charges such as alcoholic beverages, spa services, and Internet usage; security fees; taxes or other expenses are the responsibility solely of winner. The winner and his/her travel companion must execute liability/publicity releases prior to issuance of travel documents. The winner and travel companion are solely responsible for obtaining valid passports and any other documents necessary for international travel. The sponsor reserves the right to substitute the trip for one of equal or greater value if the designated prize should become unavailable for any reason.

 The approximate Retail Value (“ARV”) of the First Prize is US $6,250.

Failure to execute and deliver any required documents to Sponsor by the specified deadline may result in disqualification from the Contest, and selection of an alternate potential winner. No prize transfer, assignment, or substitution by winners allowed. If a prize (or part of a prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law.

JUDGING PROCESS

The Caribbean Photo Contest follows a two-tiered voting process to determine the winners:

The First Round consists of Public Voting. Public Voting Period: May 11 – May 17, 2025.  All eligible contest entries are open for public voting. The most popular entries, based on public votes, advance to the next round. The Second Round consists of the Judges’ Panel Evaluation. Judging Panel Review: May 18 – 24, 2025.  A panel of expert judges in photography (the “Judges”) will review the finalist entries.

Each entry will be evaluated using the following Judging Criteria: Creativity (50%) Photographic Quality (50%)

*Judges will select the Finalists, from which they will determine the Grand Prize Winner, Finalists, and Honorable Mentions. The Grand Prize Winner, Finalists, and Honorable Mentions will be officially announced and published on the Caribbean Photo Contest website and social media platforms. *Limit one (1) Grand prize winner. ENTRANT LICENSES/RELEASES

By submitting images, you understand and agree that selected entries and the entrants’ names can and may be used and published by Caribbean Photo Contest LLC or any other Authorized Party in any CPC contest and all CPC promotional or advertising material, publications, or its own website, or any other media at the discretion of the CPC. The photographer retains all copyrights. Recognition will be given to the photographer whenever possible. By entering the Contest, all entrants grant a royalty free irrevocable perpetual non-exclusive license in the entries to Authorized parties and Acknowledge that Authorized Parties may use the entries and a name credit in any media now or hereafter known, without the restriction, including commercially fully using and exploiting the entries possible. Display or publication of any entry on an Authorized Party’s website does not indicate the entrant will be selected as a winner. Authorized parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation. Consequently, by entering, each entrant grants to Authorized Parties the unrestricted right to use all statements made in connection with the Contest, and pictures or likeness of Contest entrants, or choose not to do so, at their sole discretion. Authorize Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation. If the photograph or photographs submitted contain any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.

Upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed release from all persons who appear in the photograph submitted, and/or from the owner of any material that appears in the photograph entry, authorizing Sponsor and its licensees (“Authorized Parties”) to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification at any time during the Contest and the selection of an alternate winner.

Similarly, upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed written license from the copyright owner of any sculpture, artwork or other copyrighted material that appears in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

Finally, upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed written license from the owner of any private property included in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

For the purposes of these Official Rules, the entrant will be deemed to be in receipt of Sponsor’s request or notification, (a) in the event that Sponsor sends the request by postal mail, five business days after the request was sent by Sponsor, or (b) in the event that Sponsor sends the request by e-mail, on the day that the e-mail was sent by Sponsor.

By participating, PROFESSIONAL contest entrants grant the Sponsors and their designees, licensees, or affiliates (the “Authorized Parties”) a non-exclusive, worldwide license, through December 24, 2029, to reproduce, distribute, display, and post the entries online so that viewers may view all competing entries. In addition, each WINNER grants to the Authorized Parties a license for use of his/her winning entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known, including but not limited to, print or digital publication on the CPC Website showcasing the winners; and promotions related to the contest. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.

THIRD PARTY RELEASES/LICENSES

Winners authorize Caribbean Photo Contest LLC to reproduce, distribute, display and create derivative works of the photograph entry in connection with 2025/26 Caribbean Photo Contest and promotion of 2025/26 Caribbean Photo Contest, in any media now or hereafter known, including but not limited to: publication on The CPC website showcasing the winners; The 2025/26 Caribbean Photo Contest online gallery; the 2025/26 Caribbean Photo Contest Website and in exhibits and promotions related to the 2025/26 Caribbean Photo Contest.

LIMITATION OF LIABILITY

By participating, entrants agree to release, discharge and hold harmless Caribbean Photo Contest LLC, and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

CONDITIONS

THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the State of Delaware and the forum for any dispute shall be in the State of Delaware, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries void if the Sponsor determines the photograph to not be original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these “All Entrants” Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins, that Sponsor may use the winning photographs and each winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law). All federal, state/provincial/territorial, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or do not respond within 10 days to a winner notification as required by the “Contest Prizes” Rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant.

The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

RIGHT TO CANCEL OR SUSPEND CONTEST

If for any reason the Contest is not capable of running as planned, due to a cyber-attack or attacks, infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsors elect to cancel or terminate the Contest, Sponsors will not retain any rights in the submitted photographs and will return the entry fees.

DATA PRIVACY

Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The Sponsor may also use the data to verify the participant’s identity, postal address, and telephone number or to verify the participant’s eligibility to participate in the Contest. Participants have the right to access, review, rectify or cancel any personal data held by Sponsor by writing to Sponsor at [email protected]. Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.

NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by Caribbean Photo Contest to mail skill contests or sweepstakes. To elect to have an individual’s name excluded from all such lists, submit a removal request in writing at [email protected]. This notification system may be used to prohibit mailing of all skill contests or sweepstakes by the Caribbean Photo Contest to such individuals.

Caribbean Photo Contest is in no way sponsored, endorsed, or administered by, or associated with TikTok, Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn, or Google. You understand that you are providing your information to the owner of this contest and not to TikTok, Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn, or Google.

You will not be notified upon our receipt of your entry. Further, please be aware that we are unable to respond to any requests to confirm our receipt of an entry.

Entries will not be accepted by any method other than the Internet.

Entrants will be responsible for all costs associated with entering the contest.

By entering this contest, the entrant will be deemed to have agreed to the terms and conditions stated in these Entry Guidelines.

The Organizer has final decision-making authority regarding any matters not specified in these Entry Guidelines. Please be aware that, in the judging and usage of submitted works, due to printing variation or other factors, it may not be possible to strictly reproduce the color tones or presentation intended by the entrant, and that parts of works may be cropped for publicity purposes.

Please be aware that we will not be able to respond to any inquiries, complaints, objections, or the like regarding the judging results of this contest.

Prizes are subject to change without notice depending on product lineup.

If delivery of a prize is delayed or made impossible due to international factors, legal issues, or other circumstances, a prize may be substituted with a monetary award designated by the Organizer. Moreover, if delivering a monetary award or prize directly is difficult, we may take measures such as delivery via a third country or third party to the extent possible.

RESPONSIBILITY

Although entries will be managed with the utmost care, the Organizer assumes no responsibility for any accident, damage, loss, or other problems that occur during data transmission.

The Organizer assumes no responsibility for any network failures, computer viruses, unauthorized server access, or other circumstances beyond the Organizer’s control, or for any damages or the like incurred by the entrant in connection with such circumstances.

The Organizer assumes no responsibility for damages that the entrant may suffer in connection with entering this contest.

Entrants will be deemed to have obtained prior consent from the subjects, original authors, or other right holders for the use of any subjects, copyrighted material, or the like that is used in their entries. Any resulting complaints or objections are not the responsibility of the Organizer and must be resolved entirely by the entrant.

Any complaints or claims of rights infringement, compensation of damages, or the like by third parties in connection with the submitted work are not the responsibility of the Organizer and must be resolved entirely by the entrant.

Any problems that arise regarding similarities to the submitted work or the like must be resolved entirely by the parties between themselves. Any resulting complaints or objections are not the responsibility of the Organizer and must be resolved entirely by the entrant.

The liability towards entrants of the Organizer, any third parties cooperating with the Organizer to run this contest, and the judges will also be managed in accordance with the above.

ENTRANTS RIGHTS

The copyright and any equivalent rights to the submitted work will belong to the entrant. However, the Organizer will have the rights set forth in “Organizer’s Rights” below in connection with the submitted work.

ORGANIZERS RIGHTS

The Organizer will have the right to publish any work on its official social media accounts during the judging period for the purpose of publicizing this contest. However, this does not guarantee that the work will win a prize.

The Organizer reserves the right to publish works that reach the final judging stage of this contest on affiliated websites and social media accounts. Works published by the Organizer may be cropped when displayed.

The Organizer will have the perpetual, non-exclusive right, for the purposes of publicizing this contest and contributing to photography culture in general, to authorize the publication; reproduction; presentation; public transmission to social media, the Internet, email newsletters, etc.; exhibition; printing; distribution; adaptation; or screening of the winning works, without compensation, with credit given, and without requiring the winners’ permission, on websites or official social media accounts or at photo exhibitions, video-related events, other exhibitions, or the facilities that host them, which are managed or organized by Caribbean Photo Contest or the Organizer’s authorized local agents (hereinafter referred to, with the inclusion of the Organizer, as the “Organizer or its Affiliates”).

The Organizer has the right to transfer printed materials or other reproductions of the winning entries to a third party after the exhibition is completed without the permission of the winners.

To the extent that winning works are exhibited at exhibitions and the like, there may be restrictions on the winning works to be exhibited due to global events or circumstances in the area of the exhibition.

The Organizer will announce the names of the winners and the titles of the winning works on websites connected with this contest, official social media accounts, exhibitions, and the like. Entrants should also review our Privacy Statement at https://www.caribbeanphotocontest.com/privacy

Notwithstanding the above, the Organizer or its Affiliates may not give credit if using all or parts of winning works in publicity posters, tickets, pamphlets, or other media for photo exhibitions or video-related events or on websites or social media accounts managed by the Organizer or its Affiliates where all or parts of winning works are used in videos or images with image effects such as collages or in other circumstances where it would be difficult to give credit.

Winners will not exercise any moral rights regarding the use of winning works by the Organizer or its Affiliates.

Upon obtaining the consent of the entrant or winner, the Organizer will have the perpetual, non-exclusive right, for purposes other than those stated above, to authorize the publication, reproduction, presentation, public transmission, exhibition, printing, distribution, adaptation, or screening of a submitted or winning work, without compensation, with credit given, and stating that the work was submitted to or won this contest.

If the Organizer determines that an entry violates the entry guidelines, the entry will be invalid. No notice of the entry’s invalidity will be given.

If an entrant is found to be in violation of the terms or conditions after a prize has been awarded, the Organizer can cancel the award and demand the return of the prize.

These Entry Guidelines will be interpreted in accordance with the laws of the State of Delaware.

The “Teen” contest is for visual artists and photo enthusiasts of any skill level who must be at least 13 years of age at the date contest begins, but no older than 17 years of age by the date the contest ends. The contest helps young photographers grow and flourish into the next stages of their careers. Judges are looking for good composition, creativity, and clear photographs. Judging will be based on a single image or a series of images depending on the submission entry.

REQUIREMENTS

Photographs must be in digital format. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Contest. The photograph need not be taken with a digital camera; scans of negatives, transparencies or photographic prints are acceptable. Digital photographs should be submitted at 150dpi.

All digital files must not exceed 4MB (megabytes) per file in RGB format, or saved as JPEGs (.jpg) format, and must be at least 1,000 pixels wide (if a horizontal image) or 1,000 pixels tall (if a vertical image). Photographs must have been taken within two (2) years before the date of entry and may not have previously won an award in the Caribbean Photo Contest.

Only minor burning, dodging and/or color correction is acceptable, as is cropping. High dynamic range images (HDR) and stitched panoramas are NOT acceptable. Any changes to the original Photograph not itemized here are unacceptable and will render the Photograph ineligible for a prize.

Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; provided that entrants must be prepared to provide a release form as described below in “Release”. Photographing the work of others is NOT allowed.

The photograph, in its entirety, must be a single or series of works of original material taken by the Contest entrant. By entering the Contest, entrant represents, acknowledges and warrants that the submitted photograph is an original work/s created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photograph.

The photograph must not, in the sole and unfettered discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, pornographic, or otherwise objectionable or inappropriate content.

All entries will be judged in accordance with the Judging Criteria, as defined below. All entries must be submitted and received by May 10, 2025, at 11:59:00 pm US Eastern Standard Time (EST). Proof of submission is not proof of receipt. Entries must be made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, Internet domain owner, or other person or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The sponsor reserves the right to examine the original photograph/source material in order to confirm compliance with these rules.

Note: The entry submission page is expected to receive many visitors immediately before the entry deadline. If the website is experiencing a lot of traffic, issues may arise such as slow processing times or the inability to submit entries. To avoid these potential problems, you are encouraged to submit your entries about 14 days before the entry deadlines.

JUDGING PROCESS

The Caribbean Photo Contest follows a two-tiered voting process to determine the winners:

The First Round consists of Public Voting. Public Voting Period: May 25 – May 31, 2025.  All eligible contest entries are open for public voting. The most popular entries, based on public votes, advance to the next round. The Second Round consists of the Judges’ Panel Evaluation. Judging Panel Review: June 1 – June 7, 2025. A panel of expert judges in photography (the “Judges”) will review the finalist entries. w the finalist entries.

Each entry will be evaluated using the following Judging Criteria: Creativity (50%) Photographic Quality (50%)

ENTRANT LICENSES/RELEASES

By submitting images, you understand and agree that selected entries and the entrants’ names can and may be used and published by Caribbean Photo Contest LLC or any other Authorized Party in any CPC contest and all CPC promotional or advertising material, publications, or its own website, or any other media at the discretion of the CPC. The photographer retains all copyrights. Recognition will be given to the photographer whenever possible. By entering the Contest, all entrants grant a royalty free irrevocable perpetual non-exclusive license in the entries to Authorized parties and Acknowledge that Authorized Parties may use the entries and a name credit in any media now or hereafter known, without the restriction, including commercially fully using and exploiting the entries possible. Display or publication of any entry on an Authorized Party’s website does not indicate the entrant will be selected as a winner. Authorized parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation. Consequently, by entering, each entrant grants to Authorized Parties the unrestricted right to use all statements made in connection with the Contest, and pictures or likeness of Contest entrants, or choose not to do so, at their sole discretion. Authorize Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation. If the photograph or photographs submitted contain any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.

Upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed release from all persons who appear in the photograph submitted, and/or from the owner of any material that appears in the photograph entry, authorizing Sponsor and its licensees (“Authorized Parties”) to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification at any time during the Contest and the selection of an alternate winner.

Similarly, upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed written license from the copyright owner of any sculpture, artwork or other copyrighted material that appears in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

Finally, upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed written license from the owner of any private property included in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

For the purposes of these Official Rules, the entrant will be deemed to be in receipt of Sponsor’s request or notification, (a) in the event that Sponsor sends the request by postal mail, five business days after the request was sent by Sponsor, or (b) in the event that Sponsor sends the request by e-mail, on the day that the e-mail was sent by Sponsor.

By participating, PROFESSIONAL contestants grant the Sponsors and their designees, licensees, or affiliates (the “Authorized Parties”) a non-exclusive, worldwide license, through December 24, 2029, to reproduce, distribute, display, and post the entries online so that viewers may view all competing entries. In addition, each WINNER grants to the Authorized Parties a license for use of his/her winning entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known, including but not limited to, print or digital publication on the CPC Website showcasing the winners; and promotions related to the contest. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.

THIRD PARTY RELEASES/LICENSES

Winners authorize Caribbean Photo Contest LLC to reproduce, distribute, display and create derivative works of the photograph entry in connection with 2025/26 Caribbean Photo Contest and promotion of 2025/26 Caribbean Photo Contest, in any media now or hereafter known, including but not limited to: publication on The CPC website showcasing the winners; The 2025/26 Caribbean Photo Contest online gallery; the 2025/26 Caribbean Photo Contest Website and in exhibits and promotions related to the 2025/26 Caribbean Photo Contest.

LIMITATION OF LIABILITY

By participating, entrants agree to release, discharge and hold harmless Caribbean Photo Contest LLC, and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

CONDITIONS

THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the State of Delaware and the forum for any dispute shall be in the State of Delaware, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries void if the Sponsor determines the photograph to not be original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these “All Entrants” Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins, that Sponsor may use the winning photographs and each winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law). All federal, state/provincial/territorial, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or do not respond within 10 days to a winner notification as required by the “Contest Prizes” Rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant.

The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

RIGHT TO CANCEL OR SUSPEND CONTEST

If for any reason the Contest is not capable of running as planned, due to a cyber-attack or attacks, infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsors elect to cancel or terminate the Contest, Sponsors will not retain any rights in the submitted photographs and will return the entry fees.

DATA PRIVACY

Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The Sponsor may also use the data to verify the participant’s identity, postal address, and telephone number or to verify the participant’s eligibility to participate in the Contest. Participants have the right to access, review, rectify or cancel any personal data held by Sponsor by writing to Sponsor at [email protected]. Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.

NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by Caribbean Photo Contest to mail skill contests or sweepstakes. To elect to have an individual’s name excluded from all such lists, submit a removal request in writing at [email protected]. This notification system may be used to prohibit mailing of all skill contests or sweepstakes by the Caribbean Photo Contest to such individuals.

Please be aware that we will not be able to respond to any inquiries, complaints, objections, or the like regarding the judging results of this contest.

Prizes are subject to change without notice depending on product lineup.

If delivery of a prize is delayed or made impossible due to international factors, legal issues, or other circumstances, a prize may be substituted with a monetary award designated by the Organizer. Moreover, if delivering a monetary award or prize directly is difficult, we may take measures such as delivery via a third country or third party to the extent possible.

RESPONSIBILITY

Although entries will be managed with the utmost care, the Organizer assumes no responsibility for any accident, damage, loss, or other problems that occur during data transmission.

Any complaints or claims of rights infringement, compensation of damages, or the like by third parties in connection with the submitted work are not the responsibility of the Organizer and must be resolved entirely by the entrant.

Any problems that arise regarding similarities to the submitted work or the like must be resolved entirely by the parties between themselves. Any resulting complaints or objections are not the responsibility of the Organizer and must be resolved entirely by the entrant.

The liability towards entrants of the Organizer, any third parties cooperating with the Organizer to run this contest, and the judges will also be managed in accordance with the above.

ENTRANTS RIGHTS

The copyright and any equivalent rights to the submitted work will belong to the entrant. However, the Organizer will have the rights set forth in “Organizer’s Rights” below in connection with the submitted work.

ORGANIZERS RIGHTS

The Organizer will have the right to publish any work on its official social media accounts during the judging period for the purpose of publicizing this contest. However, this does not guarantee that the work will win a prize.

The Organizer reserves the right to publish works that reach the final judging stage of this contest on affiliated websites and social media accounts. Works published by the Organizer may be cropped when displayed.

The Organizer will have the perpetual, non-exclusive right, for the purposes of publicizing this contest and contributing to photography culture in general, to authorize the publication; reproduction; presentation; public transmission to social media, the Internet, email newsletters, etc.; exhibition; printing; distribution; adaptation; or screening of the winning works, without compensation, with credit given, and without requiring the winners’ permission, on websites or official social media accounts or at photo exhibitions, video-related events, other exhibitions, or the facilities that host them, which are managed or organized by Caribbean Photo Contest or the Organizer’s authorized local agents (hereinafter referred to, with the inclusion of the Organizer, as the “Organizer or its Affiliates”).

The Organizer has the right to transfer printed materials or other reproductions of the winning entries to a third party after the exhibition is completed without the permission of the winners.

To the extent that winning works are exhibited at exhibitions and the like, there may be restrictions on the winning works to be exhibited due to global events or circumstances in the area of the exhibition.

The Organizer will announce the names of the winners and the titles of the winning works on websites connected with this contest, official social media accounts, exhibitions, and the like. Entrants should also review our Privacy Statement at https://www.caribbeanphotocontest.com/privacy

Notwithstanding the above, the Organizer or its Affiliates may not give credit if using all or parts of winning works in publicity posters, tickets, pamphlets, or other media for photo exhibitions or video-related events or on websites or social media accounts managed by the Organizer or its Affiliates where all or parts of winning works are used in videos or images with image effects such as collages or in other circumstances where it would be difficult to give credit.

Winners will not exercise any moral rights regarding the use of winning works by the Organizer or its Affiliates.

Upon obtaining the consent of the entrant or winner, the Organizer will have the perpetual, non-exclusive right, for purposes other than those stated above, to authorize the publication, reproduction, presentation, public transmission, exhibition, printing, distribution, adaptation, or screening of a submitted or winning work, without compensation, with credit given, and stating that the work was submitted to or won this contest.

If the Organizer determines that an entry violates the entry guidelines, the entry will be invalid. No notice of the entry’s invalidity will be given.

If an entrant is found to be in violation of the terms or conditions after a prize has been awarded, the Organizer can cancel the award and demand the return of the prize.

Photographs that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; provided that entrants must be prepared to provide a release form as described below in “Release”. Photographing the work of others is NOT allowed.

The photograph, in its entirety, must be a single or series of works of original material taken by the Contest entrant. By entering the Contest, entrant represents, acknowledges and warrants that the submitted photograph is an original work/s created solely by the entrant, that the photograph does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photograph.

The photograph must not, in the sole and unfettered discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, pornographic, or otherwise objectionable or inappropriate content.

The entries will be judged in accordance with the Judging Criteria, as defined below. All entries must be submitted and received by May 5, 2025, at 11:59:00 pm US Eastern Standard Time (EST). Proof of submission is not proof of receipt. Entries must be made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, Internet domain owner, or other person or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The sponsor reserves the right to examine the original photograph/source material in order to confirm compliance with these rules.

Note: The entry submission page is expected to receive many visitors immediately before the entry deadline. If the website is experiencing a lot of traffic, issues may arise such as slow processing times or the inability to submit entries. To avoid these potential problems, you are encouraged to submit your entries about 14 days before the entry deadlines.

All Entrants must include the appropriate entry fee payable in U.S. currency.

PAYMENT: The entry fee consists of two submission options 1) $25 USD – single image entrance fee or 2) $40.00 USD-Series (2 to 10 images) entrance fee. There is no limit on the number of entries.

The Spring – 2025 contest is an “Open Theme”. There is no limit on the number of entries per person. Each entry must comply with the following requirements previously stated above.

IDENTIFYING MARKS & SIGNATURES

No signature, stamp or any other identifying mark is allowed anywhere on the image or digital file. Any submissions that include or contain such marks are automatically disqualified.

CONTEST PRIZES

One (1) Grand Prize will be awarded.

Grand Prize: One (1) Five (5) day Four (4) nights’ accommodation in Saint Lucia for the winner and one (1) guest in 2025; The winning image or images will be featured on the CPC website, newsletter, and social media.

The Grand Prize will include one Five (5) day Four (4) nights’ accommodation in Saint Lucia which includes ground transportation between the airport and hotel; and meals and other items including trip details are determined by Sponsor in its sole discretion. Travel must be completed by December 31, 2026, or the prize trip will be forfeited. Airfare is NOT included. Travel expenses to/from the prize winner’s home city are not included. Trip dates relate to travel from the United States. Accommodation is subject to availability. Trip specifics are subject to availability. Travelers agree to accept the Caribbean Photo Contest terms and conditions for the trip. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation; meals; incidentals; gratuities; passenger tariffs or duties; airline fees; surcharges; airport fees; service charges or facility charges; personal charges such as alcoholic beverages, spa services, and Internet usage; security fees; taxes or other expenses are the responsibility solely of winner. The winner and his/her travel companion must execute liability/publicity releases prior to issuance of travel documents. The winner and travel companion are solely responsible for obtaining valid passports and any other documents necessary for international travel. The sponsor reserves the right to substitute the trip for one of equal or greater value if the designated prize should become unavailable for any reason.

 The approximate Retail Value (“ARV”) of the First Prize is US $8,250.

Potential winners shall be required to sign and return within ten (10) days following an attempted notification, an Affidavit, Declaration or Certificate of Eligibility, Liability Release, and where legally permissible, a Publicity Release and Warranty of Ownership and License in which the entrant warrants that he/she is the owner of the photograph (and all the intellectual property rights in the photograph submitted) and grants to Sponsor and its licensees the irrevocable, perpetual, worldwide non-exclusive license to reproduce, distribute, display, and create derivative works of the entry (along with a name credit) in connection with the Contest and promotion of the Contest without additional compensation. Failure to execute and deliver any required documents to Sponsor by the specified deadline may result in disqualification from the Contest, and selection of an alternate potential winner. No prize transfer, assignment, or substitution by winners allowed. If a prize (or part of a prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law.

NONCOMPLIANCE OR RETURN OF PRIZE NOTIFICATION AS UNDELIVERABLE, WHETHER BY REGULAR MAIL OR BY E-MAIL, MAY RESULT IN DISQUALIFICATION AND SELECTION OF AN ALTERNATIVE POTENTIAL WINNER.

JUDGING PROCESS

The Caribbean Photo Contest follows a two-tiered voting process to determine the winners:

The First Round consists of Public Voting. Public Voting Period: May 25 – May 31, 2025.  All eligible contest entries are open for public voting. The most popular entries, based on public votes, advance to the next round. The Second Round consists of the Judges’ Panel Evaluation. Judging Panel Review: June 1 – June 7, 2025. A panel of expert judges in photography (the “Judges”) will review the finalist entries. d consists of the Judges’ Panel Evaluation. Judging Panel Review: May 18 – 24, 2025 A panel of expert judges in photography (the “Judges”) will review the finalist entries.

Each entry will be evaluated using the following Judging Criteria: Creativity (50%) Photographic Quality (50%)

*Judges will select the Finalists, from which they will determine the Grand Prize Winner, Finalists, and Honorable Mentions. The Grand Prize Winner, Finalists, and Honorable Mentions will be officially announced and published on the Caribbean Photo Contest website and social media platforms. *Limit one (1) Grand prize winner. (Please Note: The results will render only one (1) Grand Prize winner and three (3) finalist/s and one Honorable Mention). Prize winners will be notified by email and announced on our website, e-newsletter, no later than 6 weeks after the end date of the contest.)

**The CPC reserves the exclusive right regarding judging to determine winners. Decisions of the Judges are final and binding. Sponsors reserve the right not to award all prizes in the event an insufficient number of eligible entries are received, as determined by Sponsors and Judges in their sole discretion.

ENTRANT LICENSES/RELEASES

By submitting images, you understand and agree that selected entries and the entrants’ names can and may be used and published by Caribbean Photo Contest LLC or any other Authorized Party in any CPC contest and all CPC promotional or advertising material, publications, or its own website, or any other media at the discretion of the CPC. All copyrights are retained by the photographer. Recognition will be given to the photographer whenever possible. By entering the Contest, all entrants grant a royalty free irrevocable perpetual non-exclusive license in the entries to Authorized parties and Acknowledge that Authorized Parties may use the entries and a name credit in any media now or hereafter known, without the restriction, including commercially fully using and exploiting the entries possible. Display or publication of any entry on an Authorized Party’s website does not indicate the entrant will be selected as a winner. Authorized parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation. Consequently, by entering, each entrant grants to Authorized Parties the unrestricted right to use all statements made in connection with the Contest, and pictures or likeness of Contest entrants, or choose not to do so, at their sole discretion. Authorize Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use or exploitation. If the photograph or photographs submitted contain any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the exhibition and use of the photograph in the manner set forth in these Official Rules without additional compensation. If any person appearing in any photograph is under the age of majority in their state/province/territory of residence the signature of a parent or legal guardian is required on each release.

Upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed release from all persons who appear in the photograph submitted, and/or from the owner of any material that appears in the photograph entry, authorizing Sponsor and its licensees (“Authorized Parties”) to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification at any time during the Contest and the selection of an alternate winner.

Similarly, upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed written license from the copyright owner of any sculpture, artwork or other copyrighted material that appears in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

Finally, upon Sponsor’s request, each entrant must be prepared to provide (within 10 calendar days of receipt of Sponsor’s request) a signed written license from the owner of any private property included in the photograph entry, authorizing any Authorized Party to reproduce, distribute, display and create derivative works of the entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known. All releases must be in the form provided by the Sponsor. Failure to provide such releases upon request may result in disqualification and selection of an alternate winner.

For the purposes of these “Professional Contest” Official Rules, the entrant will be deemed to be in receipt of Sponsor’s request or notification, (a) in the event that Sponsor sends the request by postal mail, five business days after the request was sent by Sponsor, or (b) in the event that Sponsor sends the request by e-mail, on the day that the e-mail was sent by Sponsor.

By participating, contest participants grant the Sponsors and their designees, licensees, or affiliates (the “Authorized Parties”) a non-exclusive, worldwide license, through December 24, 2029, to reproduce, distribute, display, and post the entries online so that viewers may view all competing entries. In addition, each WINNER grants to the Authorized Parties a license for use of his/her winning entry in connection with the Contest and promotion of the Contest, in any media now or hereafter known, including but not limited to, print or digital publication on the CPC Website showcasing the winners; and promotions related to the contest. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.

THIRD PARTY RELEASES/LICENSES

Winners authorize Caribbean Photo Contest LLC to reproduce, distribute, display and create derivative works of the photograph entry in connection with 2025/26 Caribbean Photo Contest and promotion of 2025/26 Caribbean Photo Contest, in any media now or hereafter known, including but not limited to: publication on The CPC website showcasing the winners; The 2025/26 Caribbean Photo Contest online gallery; the 2025/26 Caribbean Photo Contest Website and in exhibits and promotions related to the 2025/26 Caribbean Photo Contest.

LIMITATION OF LIABILITY

By participating, entrants agree to release, discharge and hold harmless Caribbean Photo Contest LLC, and each of their respective partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest or any Contest-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder.

CONDITIONS

THIS CONTEST IS VOID WHERE PROHIBITED. Entrants agree that this Contest shall be subject to and governed by the laws of the State of Delaware and the forum for any dispute shall be in the State of Delaware, United States of America. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any entrant expressly waives any and all such rights. Certain restrictions may apply. Entries void if the Sponsor determines the photograph to not be original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft.

By entering, entrants also agree (a) to be bound by these “All Entrants” Official Rules; (b) that the decisions of the Judges are final and binding with respect to all matters relating to the Contest; and (c) if the entrant wins, that Sponsor may use the winning photographs and each winner’s name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except where prohibited by law). All federal, state/provincial/territorial, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes are the sole responsibility of the prize winners. In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced or do not respond within 10 days to a winner notification as required by the “Contest Prizes” Rules above, or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another entrant.

The Sponsor reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who submits an entry that is not in accordance with these Official Rules or who tampers with the entry process. Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.

RIGHT TO CANCEL OR SUSPEND CONTEST

If for any reason the Contest is not capable of running as planned, due to a cyber-attack or attacks, infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right, at their sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Contest. If Sponsors elect to cancel or terminate the Contest, Sponsors will not retain any rights in the submitted photographs and will return the entry fees.

DATA PRIVACY

Entrants agree that personal data, especially name and address, may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The Sponsor may also use the data to verify the participant’s identity, postal address, and telephone number or to verify the participant’s eligibility to participate in the Contest. Participants have the right to access, review, rectify or cancel any personal data held by Sponsor by writing to Sponsor at [email protected]. Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.

NOTICE TO INDIVIDUALS: REMOVAL FROM MAILING LIST: Any individual (or other duly authorized person) may elect to exclude the name and address of that individual from all lists used by Caribbean Photo Contest to mail skill contests or sweepstakes. To elect to have an individual’s name excluded from all such lists, submit a removal request in writing at [email protected]. This notification system may be used to prohibit mailing of all skill contests or sweepstakes by the Caribbean Photo Contest to such individuals.

Caribbean Photo Contest is in no way sponsored, endorsed, or administered by, or associated with TikTok, Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn, or Google. You understand that you are providing your information to the owner of this contest and not to TikTok, Facebook, Twitter, Instagram, Snapchat, YouTube, Pinterest, LinkedIn, or Google.

You will not be notified upon our receipt of your entry. Further, please be aware that we are unable to respond to any requests to confirm our receipt of an entry.

Entries will not be accepted by any method other than the Internet.

Entrants will be responsible for all costs associated with entering the contest.

By entering this contest, the entrant will be deemed to have agreed to the terms and conditions stated in these Entry Guidelines.

The Organizer has final decision-making authority regarding any matters not specified in these Entry Guidelines. If an entrant disagrees with the decision of the Organizer, the entrant may withdraw from the contest. The entrant will be responsible for all costs associated with withdrawal from the contest.

Please be aware that the Organizer may completely or partially postpone or suspend acceptance of entries if it determines that the smooth running, safety, or fairness in judging of this contest would be compromised for reasons beyond the Organizer’s control, such as network failures, computer viruses, or unauthorized server access.

Please be aware that, in the judging and usage of submitted works, due to printing variation or other factors, it may not be possible to strictly reproduce the color tones or presentation intended by the entrant, and that parts of works may be cropped for publicity purposes.

Please be aware that we will not be able to respond to any inquiries, complaints, objections, or the like regarding the judging results of this contest.

Prizes are subject to change without notice depending on product lineup.

If delivery of a prize is delayed or made impossible due to international factors, legal issues, or other circumstances, a prize may be substituted with a monetary award designated by the Organizer. Moreover, if delivering a monetary award or prize directly is difficult, we may take measures such as delivery via a third country or third party to the extent possible.

Responsibility

Although entries will be managed with the utmost care, the Organizer assumes no responsibility for any accident, damage, loss, or other problems that occur during data transmission.

The Organizer assumes no responsibility for any network failures, computer viruses, unauthorized server access, or other circumstances beyond the Organizer’s control, or for any damages or the like incurred by the entrant in connection with such circumstances.

The Organizer assumes no responsibility for damages that the entrant may suffer in connection with entering this contest.

Entrants will be deemed to have obtained prior consent from the subjects, original authors, or other right holders for the use of any subjects, copyrighted material, or the like that is used in their entries. Any resulting complaints or objections are not the responsibility of the Organizer and must be resolved entirely by the entrant.

Any complaints or claims of rights infringement, compensation of damages, or the like by third parties in connection with the submitted work are not the responsibility of the Organizer and must be resolved entirely by the entrant.

Any problems that arise regarding similarities to the submitted work or the like must be resolved entirely by the parties between themselves. Any resulting complaints or objections are not the responsibility of the Organizer and must be resolved entirely by the entrant.

The liability towards entrants of the Organizer, any third parties cooperating with the Organizer to run this contest, and the judges will also be managed in accordance with the above.

Entrant’s Rights

The copyright and any equivalent rights to the submitted work will belong to the entrant. However, the Organizer will have the rights set forth in “Organizer’s Rights” below in connection with the submitted work.

Organizer’s Rights

The Organizer will have the right to publish any work on its official social media accounts during the judging period for the purpose of publicizing this contest. However, this does not guarantee that the work will win a prize.

The Organizer reserves the right to publish works that reach the final judging stage of this contest on affiliated websites and social media accounts. Works published by the Organizer may be cropped when displayed.

The Organizer will have the perpetual, non-exclusive right, for the purposes of publicizing this contest and contributing to photography culture in general, to authorize the publication; reproduction; presentation; public transmission to social media, the Internet, email newsletters, etc.; exhibition; printing; distribution; adaptation; or screening of the winning works, without compensation, with credit given, and without requiring the winners’ permission, on websites or official social media accounts or at photo exhibitions, video-related events, other exhibitions, or the facilities that host them, which are managed or organized by Caribbean Photo Contest or the Organizer’s authorized local agents (hereinafter referred to, with the inclusion of the Organizer, as the “Organizer or its Affiliates”).

The Organizer has the right to transfer printed materials or other reproductions of the winning entries to a third party after the exhibition is completed without the permission of the winners.

To the extent that winning works are exhibited at exhibitions and the like, there may be restrictions on the winning works to be exhibited due to global events or circumstances in the area of the exhibition.

The Organizer will announce the names of the winners and the titles of the winning works on websites connected with this contest, official social media accounts, exhibitions, and the like. Entrants should also review our Privacy Statement at https://www.caribbeanphotocontest.com/privacy

Notwithstanding the above, the Organizer or its Affiliates may not give credit if using all or parts of winning works in publicity posters, tickets, pamphlets, or other media for photo exhibitions or video-related events or on websites or social media accounts managed by the Organizer or its Affiliates where all or parts of winning works are used in videos or images with image effects such as collages or in other circumstances where it would be difficult to give credit.

Winners will not exercise any moral rights regarding the use of winning works by the Organizer or its Affiliates.

Upon obtaining the consent of the entrant or winner, the Organizer will have the perpetual, non-exclusive right, for purposes other than those stated above, to authorize the publication, reproduction, presentation, public transmission, exhibition, printing, distribution, adaptation, or screening of a submitted or winning work, without compensation, with credit given, and stating that the work was submitted to or won this contest.

If the Organizer determines that an entry violates the entry guidelines, the entry will be invalid. No notice of the entry’s invalidity will be given.

If an entrant is found to be in violation of the terms or conditions after a prize has been awarded, the Organizer can cancel the award and demand the return of the prize.

These Entry Guidelines will be interpreted in accordance with the laws of the State of Delaware.

The terms and conditions of entry are subject to change without notice. Any disputes that may arise between the entrant and the Organizer will be subject to the exclusive jurisdiction of the State of Delaware as the court of first instance.
